The Board of Review is an independent statutory tribunal established under s.65 of the IRO to hear appeals from taxpayers who are dissatisfied with the Commissioner of Inland Revenue's determination of their objection. It is composed of a legally qualified chairman and two members. The Board has the power to confirm, reduce, increase, or annul tax assessments. Its decisions are publicly published and can be appealed further to the Court of First Instance on a point of law.
You have 1 month from the date of the Commissioner's Determination on your objection to file a Notice of Appeal with the Board of Review. This is a strict deadline. If you miss it, you may apply for an extension — but this requires showing good reason for the delay and is not guaranteed. The Notice of Appeal must state the grounds of appeal and the amount of tax in dispute.
Common Board of Review issues include: (1) Whether income is sourced in Hong Kong or offshore — the operations test; (2) Whether property transactions are capital (not taxable) or trading (taxable); (3) Employment vs contractor status; (4) Deductibility of specific expenses; (5) Capital allowance classification; (6) Transfer pricing and related party transactions; (7) Penalty assessments; and (8) Stamp duty assessments.
